Desk Top Appraisal & Advice
Firstly it is important to see if your case would be better tackled by a revised application. We are able to offer a free desk top appraisal of your case and offer advice on the best course of action initially. If we do not consider an appeal is the best route for your proposal we will advise accordingly.
We offer fixed rates for householder appeals, starting at £495 +VAT. Other appeals will be quoted for on a case by case basis.
The Planning Inspectorate does not currently charge a fee for processing an appeal; except enforcement appeals in certain circumstances.
Methods of appeal
There are three types of appeal:
- Written Representation – this is the quickest method. The appellant and the Council prepare written statements for the Planning Inspectorate to consider. A Planning Inspector will visit the site, normally unaccompanied, and issue a decision. A householder appeal can be undertaken by the written representation method only.
- Hearing – with the agreement of both parties and where the planning issues are quite straightforward a hearing might be called. This is a relatively informal discussion of the issues involved between the parties which are led by the Planning Inspector.
- Public Inquiry – each side presents its case verbally before an Inspector and the witnesses are cross-examined by opposing parties in a court room environment. This is the most costly and lengthy form of appeal as it involves professional legal representation and complex arguments.
Whilst we undertake all types of appeal, 99.9% of our appeal work is by the written representation method as it’s the most simple and quickest method of appealing.
We offer a 2-3 week turnaround from instruction to submission of the appeal.
For a premium we are able to offer an expedited turnaround service which, in most cases, could be less than 24hrs. [this would need to be assessed on a case by case basis and dependant on other deadlines for that period].
The Planning Inspectorate aim to issue a decision for householder appeals within 8 weeks of the start date of the appeal and for written representation planning appeals within 16 weeks of the start date of the appeal.
In most instances for an appeal a site visit from our team is not essential. However should you consider it would be more practical to meet on site, we can offer a low rate site visit service starting at £85 +VAT, plus expenses. [Dependant on location]
Planning Inspector will visit all appeal sites. In most cases these are unaccompanied.
